Yes, when a cheque bounces due to insufficient funds, it is considered a criminal offence under the Negotiable Instruments Act, 1881 in India. The person who issued the bounced cheque can be prosecuted and punished with imprisonment up to two years or with fine which may extend to twice the amount of the cheque.
