H1 is not for Intra Company Transfer. In case of L1 it is a
Intra Company Transfer VISA. It's company dependent and
project dependent in which the employee worked for.

It is not stupid question. We have to explain him about the
advantages of the H1B like the duration of the stay. we can
tell that, "I am going to work in a long term project of
maximum of three years so my company initiated me a H1
instead of L1"

Well as all of us know that its da company who initiates
and decide which VISA is important for them so First of all
we need to say that its my company who decides this. And
might possible I need to work on long term bais so they are
asking for L1 not B1...

L1-B - When criteria mets such as, Intra company Transfer, Specialized skill set position then s/f companies will choose this one to compare H1B.
Pros: Can work at any location, Can't switch over b/w companies, Fee is less, spouse can work
Cons: 3 years only valid then you can renew for 2 more years only.
H1B : The primary US Work Visa for professionals & students from all over the world or in the USA, who work in specialty occupations. Valid up to 6 years, dual intent visa (can apply for Green Card)
Pros: Can work for diff clients, Visa renwal process is easy
Cons: can't apply this VISA for specific locations in States, spouse can't work.

Firstly you cannot work or draw US salary under B1.
Secondly L1A is Intra company transfer but the maximum stay
thats possible under L1 categories are:
L1A: 3+2+2 (With extension)
L1B: 3+2 (With extension)
If you're on H1B there is no restriction as such on you
being with a partiuclar employer. You can change jobs and
H1B can be transferred if you're in US.

if your spouse also wanted to work.. go for L1B.
In H1B your spouse cannot work.
If you are for longer term and GC...
Either your company or your spouse company can sponsor for
GC so the probability is more for longer stay if you go with
L1B rather than H1b (condition that your spouse also works
in some specialized skills to trigger the GC)
If you go with H1b/B1 than only you have the full control to
trigger the GC..

I have done Diploma in Mechanical engineering. I am going to attend interview for L1 VISA. Earlier I had worked in 3 companies and there was a gap of 6months in between. In present company i have not shown that gap.I didnt get any certificate from one company to which I havve merged that 6 months gap. How should I proceed now? please suggest me something.

HI all i have a total work ex of 4 plus years in some of the top IT companies of india. I have a btech in information technology. I was placed from college in 2006. I did my final year in 2006 but because of ill health was unable to give one paper which i gave in session 2007-2008. Now though my degree gives yr of passing as 2008 my total IT experience is 4 plus years. I need to go to US for project related work and my company is getting my L1 blanket visa stamped.
