As per Section-3(1)(i)Company means a Company Formed and
Registered under the Companies Act,1956 or any other
earlier Companies Act in India.
A Company may be Incorporated or Un-incorporated.
Incorporated Company means a Company Formed and Registered
under the Companies Act,1956 or any other earlier Companies
Act in India.
Un-incorporated Company Such as Partnership Firm , mere
Collection of Individuals.
Every Company is a Body Corporate but Every Body Corporate
is not a Company.
As the Company includes only the Company incorporated in
India whereas A Body Corporate includes both the Company
incorporated in India or Outside India.
Foreign Company can never be a Company
but
Indian Company may be a Body Corporate.
Body Corporate does Not include the Following :─
(1.) Corporation Sole (Single).
(2.) A Co-operative Society
(3.) Any other entity Notified by CG in official gazette
of India in this regard.
