Hi all,
I recently joint a pvt ltd firm which offered me gross
10000 salary Per month and 10.3%tds deduction on it. my net
salary will be 9000. My question is my salary is not
taxable then how they can deduct my tds? according to firm
tds return will get me back after 1 years ? I am totaly
confused with this pls guide me on this matter.

Hi,

Please confirm have you joined as a employee for the company
or they treated you as a consultant for the company. If you
are treated as a consultant they deduct tds for professional
Charges. If you are an employee of the company Tds is not
top be deducted from your salary.

I am fully agree with Suresh. Where you have joined they
have treated you as a consultant and giving you
professional fees and deducting TDS as per rules.They will
give you FORM 16A insteed of FORM 16 (Salaried staff)

You can argue with the company as your income is under
taxable limits i.e. 1,60,000/- a year your company is not
liable to dudect the TDS from your salary. OR You will
have to file your IT Return to get back your TDS Amount.
Better ask your company not to deduct tax

ya Mohammed is right firstly you should say to u r Company
bcz u r not liable for deduct the tds after that if they r
not agerr with u u have to file income tax return for
this u have to consult with u r c.a he will file u r itr &
u will definatley received the refund ok dont warry about
it

Hi Pravink,

If the Company has hired on Contract basis (Not as an
permanent Employee) then you are liable for TDS. Check with
the company. If u are on Permanent payroll of the company,
then company cannot deduct from ur salary as TDS.

In the next fiscal year ie after 31-MAR-2011, Company will
give u FORM 16A which shows the information of the Tax
Deducted on ur salary.
Need to Submit to IT Department. IT Dept will refund the
complete TDS amount.

if company has deducted the TDS of 10.30% then u will get
refund from IT authority at the time of filling your IT
return since your salary income is within limits of
taxable income or suggest company that your salary income
is within limits

How can it is possible, TDS percentage is 1.133% but there
are charging you around 10.3% is it TDS or else Service tax,
and person who get salary of Rs 10000/- not liable for TDS,
so you can ask your company why there are charging TDS on
what bases. okay.
