Formation of New States and alteration of the boundaries of
the existing States may be done by:

(1) President of India

(2) The State itself

(3) Parliament by Law

(4) Parliament with ratification by Legislature of not less
than half of the states

Art.3 of Constition of India provides the following
procedure: No bill for the purpose of formation of a new
state shall be introducedexcept on the recommendation of
the President and unless ,the proposal contained in Bill
affects the area,boundaries or name any of the States the
bill has been referred by the President to the Legislature
of that State for expressing their views thereon within a
period prescribed by the President.There is no requirement
that parliament shall consider them.It is mandatory that
president has to initiate the procedure and it ends by
Parliament passing the bill. The constitution does not give
as to President initiates such Procedure. The Legislatueres
of the concerned States may not have sufficient number of
members from the areas aspiring for formation of a New
state for themselves. It is therefore the Govt of India on
its satisfaction of the agitations may request the
President to initiate the procedure. Then the agitations
are not sure indications of the peoples aspirations as
obviosly they are with exasirated political cross corrents.
Further it is required to fix boudaries and sharing waters
viability economically securitywise and other guarantees
and location ofcapitals high courts and all other
requirements of the states to be formed. For this purpose a
commission has to be appointed by the President.
it is only on recept of areport of such commission if the
President is satisfied the President may recommend the bill
onthe advice of his coucil of ministers.
